Please read these Terms of Use ("Terms") carefully before using the MyZaffa application operated by H Labs Technologies LLC. By creating an account or using the service, you agree to be bound by these Terms. If you do not agree, do not use MyZaffa.
You must be at least 18 years of age to use MyZaffa. By using the service, you represent and warrant that you are 18 or older and have the legal capacity to enter into this agreement.
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to (a) provide accurate, current, and complete registration information; (b) immediately notify us of any unauthorized account use; and (c) not share your account or credentials with any unauthorized third party.
You agree not to: (a) use the service for any unlawful purpose or in violation of any applicable law; (b) harass, abuse, threaten, or defame any other user; (c) upload malicious code, viruses, or any content that interferes with the service; (d) attempt to gain unauthorized access to any part of the service; (e) scrape, reverse-engineer, or create derivative works without our express written consent; (f) use MyZaffa to facilitate fraudulent transactions or misrepresent your identity.
MyZaffa is a platform that connects couples with vendors and wedding planners. H Labs Technologies LLC is not a party to any agreement between users, is not a licensed wedding planner, and does not endorse or guarantee the quality, safety, or legality of any vendor or planner's services. All transactions, communications, and engagements between couples, vendors, and planners are solely between those parties. H Labs Technologies LLC assumes no liability for disputes, damages, or losses arising from those relationships.
MyZaffa offers optional auto-renewing subscription plans for couples, vendors, and planners. The title, length, and price of each subscription are displayed in the app before purchase and on the applicable App Store / Google Play listing. Payment is charged to your Apple ID or Google Play account at confirmation of purchase. Subscriptions automatically renew for the same length and price unless auto-renew is turned off at least 24 hours before the end of the current period. You can manage or cancel your subscription at any time in your Apple ID or Google Play account settings. Any unused portion of a free trial period, if offered, is forfeited when you purchase a subscription.
You retain ownership of content you upload (photos, documents, guest data, etc.). By uploading content, you grant H Labs Technologies LLC a limited, non-exclusive, royalty-free license to store, display, and transmit that content solely as needed to operate the service. You represent that you have all rights necessary to grant this license and that your content does not infringe any third-party rights.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. H LABS TECHNOLOGIES LLC DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES. YOUR USE OF THE SERVICE IS ENTIRELY AT YOUR OWN RISK.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL H LABS TECHNOLOGIES LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
In jurisdictions that do not allow exclusion of certain damages, our total liability to you for all claims arising out of or relating to the service shall not exceed the greater of (a) the total fees you paid to H Labs Technologies LLC in the twelve (12) months preceding the claim or (b) one hundred U.S. dollars ($100.00).
You agree to defend, indemnify, and hold harmless H Labs Technologies LLC and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or in connection with: (a) your use of the service; (b) your violation of these Terms; (c) your violation of any third-party right, including intellectual property or privacy rights; or (d) any content you submit or transmit through the service.
Informal Resolution: Before initiating formal proceedings, you agree to contact us at legal@myzaffa.app and attempt to resolve any dispute informally for at least 30 days.
Binding Arbitration: If informal resolution fails, disputes shall be resolved by binding individual arbitration under the American Arbitration Association (AAA) Consumer Arbitration Rules, not in court. You waive any right to a jury trial and to participate in class-action litigation.
Exceptions: Either party may seek injunctive or other equitable relief in a court of competent jurisdiction to prevent irreparable harm pending arbitration, and claims within small-claims court jurisdiction may be brought there.
These Terms are governed by the laws of the State of Delaware, USA, without regard to its conflict-of-law principles. To the extent court proceedings are permitted under these Terms, you consent to personal jurisdiction in the state and federal courts located in Delaware.
H Labs Technologies LLC reserves the right to suspend or terminate your account and access to the service at any time, with or without cause or notice, including for violation of these Terms. Upon termination, your right to use the service ceases immediately. Sections 6–11 survive termination.
We may revise these Terms at any time. If we make material changes, we will provide notice through the app or by email. Your continued use of MyZaffa after changes take effect constitutes your acceptance of the revised Terms.
These Terms and our Privacy Policy constitute the entire agreement between you and H Labs Technologies LLC regarding the service and supersede all prior agreements. If any provision is found unenforceable, the remaining provisions continue in full force. Failure to enforce any provision is not a waiver of future enforcement.
